New mediation rules offer contractual freedom and autonomy
The new mediation rules set by the Netherlands Mediation Institute (NMI) took effect on 1 July 2008.
They include new rules on conduct, complaints and disciplinary measures for recognized mediators.
Both the NMI’s views and developments in the profession played an important part in reframing the rules.
The basic principle was to define and set down rules only where strictly necessary, thus providing a framework for mediation and with a focus on contractual freedom and the autonomy of all concerned.
A new system to safeguard quality (certification) has been introduced and several specific problems posed by the old rules have been solved.
Provisions on the delineation of mediation were included, and a framework for situations in which confidentially need not be strictly observed was drafted.
