Recently, Van Doorne organized a seminar on new employment termination law, following government minister Donner’s plans to amend the law. His proposals prompted an ambiguous advice rendered by STAR as well as heated public debate.
After political pressure, the proposals were withdrawn.
All this prompted us to define as key issue for the seminar whether employment termination law is up for a change.
After an introduction by Professor Bouwens (Social Law professor at VU University in Amsterdam), Mr Klijn (trade union executive of FNV) and Mr Van der Hoek (subdistrict court Judge in Amsterdam), participants and speakers thoroughly discussed the subject on the basis of several theories.
In this context, a vote was taken on various concepts. In some respects, the outcome of this vote was rather unexpected.
It turned out that a large majority of (65%) of the participants –indeed- felt a need for amendment of the laws on employment termination. However, only 38% of the participants adopted the view that the present laws are too complicated.
Again, only a minority (32%) of the participants felt that more flexible laws could be a useful instrument to increase the participation of outsiders in the job market (such as immigrants and newcomers to the job market, e.g. recent graduates, young people and women).
A majority of the participants (69%) believed that there were proper reasons to adjust the County Court Formula, although the house was not unanimous as to how this should be done exactly.
Simultaneously, a large majority (73%) voted for the concept that any employer who has compiled a proper file has a very good chance of getting rid of an employee cheaply.
Finally, 77% of the participants felt for the motto – inspired by our Inland Revenue’s slogan – that our employment termination laws may never be any fun, but can become more convenient.
